Appeals Court upholds eight-year sentence for Mosta grocery worker in child abuse case

The Court of Criminal Appeal has confirmed an eight-year prison sentence for Mufarrih Shah following his conviction for the sexual abuse and harassment of a ten-year-old girl. The ruling, delivered by Madam Justice Consuelo Scerri Herrera, rejected Shah’s appeal in its entirety, upholding the original 2025 decision by the Court of Magistrates.

The abuse occurred at a Mosta grocery store where Shah was employed. He was convicted of non-consensual sexual acts, corrupting a minor under 12, and sexual harassment. The court also found him guilty of breaching immigration and employment laws, as he was working without a valid permit.

Shah’s defence argued for an acquittal, citing the lack of witnesses. They also pointed to a language barrier during legal proceedings and claimed the eight-year term was disproportionate given his previously clean criminal record.

However, the Court of Criminal Appeal prioritized the victim’s testimony, describing her as a highly intelligent and consistent witness. In contrast, the court found Shah’s testimony to be unconvincing and riddled with contradictions.

Madam Justice Scerri Herrera described the acts as disgusting and noted that the abuse appeared to be escalating. She emphasized that the victim’s courage in reporting the crimes likely prevented further harm.

In addition to the prison term, the court confirmed a three-year restraining order to protect the victim. Shah’s name will also be added to the National Register of Sex Offenders. The court concluded that the sentence fell within legal limits and serves as a vital deterrent against crimes targeting vulnerable children.
