Man fined \u20ac4,000 after running over motorcyclist in Iklin<\/p>\n
A man has been found guilty of driving recklessly and running over a motorcyclist in a collision that happened last year, and has been fined €4,000.<\/p>\n
On 8 April 2025 at around 6:15pm the Naxxar police station was informed of a collision that took place on Tal-Balal Road in Iklin, involving a Honda Fit and a Piaggio motorcycle.<\/p>\n
When the incident occurred, the accused was driving him and two of his co-workers to work at Mater Dei. The driver was confirmed to not have been speeding.<\/p>\n
In the accused’s testimony he explained that he did not stop to give way to the motorcyclist because he assumed that he would stop, as vehicles on the left side of the road coming from Għargħur direction usually tend to give way.<\/p>\n
The courts confirmed vehicles coming from the left have right of way on that particular roundabout and the driver of the Honda Fit was wrong in assuming the motorcyclist would give way.<\/p>\n
When the victim testified he stated that upon entering the big roundabout in Naxxar he kept well to the left when a car came and hit him from behind and with the impact he fell on the floor and the car proceeded to run him over.<\/p>\n
The passengers in the car recall seeing a motorcycle approaching from the left hand side and hitting the left side of the car.<\/p>\n
The Honda Fit sustained damages on the left side.<\/p>\n
The accused said that following the collision he tried to manoeuvre his car so that he would not run the motorcyclist over, explaining why his car ended up on the other side of the road, but this only caused his car to drag the motorcyclist to the other side of the road with them.<\/p>\n
He told the court how he immediately ran to the victim’s aid and waited with him until the police and ambulance arrived. The victim later told the court he remembers the accused apologising several times.<\/p>\n
The driver of the motorcycle was taken to Mater Dei hospital and was reported to be suffering from grievous injuries.<\/p>\n
As a result of the accident, the motorcyclist was hospitalised for nearly ten days and had to undergo an operation as both his arms and his legs were affected. His injuries lasted a couple months during which time he had several home visits from nurses.<\/p>\n
He told the court this accident affected him not only physically but also mentally.<\/p>\n
He explained how it has limited his ability to work as he can no longer climb the same number of stairs as before and often finds his hand hurting. His bike also suffered bad damages and the repairs needed to fix them amounted to €2,997.<\/p>\n
In following investigations, it was discovered the accused was not in possession of a valid driver’s licence at the time of the incident but did have a learner’s permit.<\/p>\n
The witnesses involved were requested to indicate with a sketch the route and direction that the vehicle was taking at the time of the incident, as well as the direction from which the motorcycle was coming so that the courts could identify who was in the wrong.<\/p>\n
The accused was found guilty of all the charges made against him and was handed a fine of €4,000. His licence was revoked for 12 months.<\/p>\n
This case was presided over by Magistrate Antoine Agius Bonnici.<\/p>\n
